The world has witnessed numerous international disputes — border and territorial conflicts as well as others. Many of these disputes have been brought before international judicial bodies, particularly the ICJ. Not all of them have ended in a judicial settlement, yet the judiciary has often played a prominent role in shaping the stages of the conflict and contributing to its resolution.
It becomes clear that the ICJ cannot be properly understood in isolation from the broader framework within which it was created and continues to operate — namely, the structure of the international system itself, with all its underlying balances, convergences and latent conflicts.
The book also demonstrates that the idea of subjecting international relations to a permanent judicial mechanism was not the outcome of an isolated historical moment, but rather the fruit of a laborious evolutionary process. Under the pressure of major wars, this process drove the search for mechanisms capable of regulating conflicts and restraining their uncontrolled escalation.
Nevertheless, this ambition has always remained conditional upon the will of states — especially the great powers — which have played a decisive role in shaping the rules of the international system and determining its course." إقرأ المزيد
